Can a company under 50 full time employees (FTE) still be required to comply with the ACA?
Are you part of a commonly controlled group or affiliated company? These companies are treated as one group for determining ALE (applicable large employer) status. They MUST combine their head counts.
If you can answer ‘Yes’ to any of the following questions it means that the companies must meet IRS Controlled Group Rules:
- Do the companies have owners in common?
- Do the companies provide services to one another?
- Jointly, do the companies provide services to others?
If you have any questions about whether you are part of a controlled or affiliated group, check first with your Chief Financial Officer and then with legal council specializing in employment law.
